Guardianship

Guardianship is the process by which one obtains the legal obligation to care for another person. That person may be a minor, as when a foster parent is needed or when the natural parent is unable to care for the minor, or that person may be an adult in the event they become unable to manage their affairs or personal needs. 

Guardianships are granted in the court having probate jurisdiction after a hearing on the petition for guardianship. 

Guardianships are often the result of a provision in the last will and testament naming someone to be guardian of their minor children. The court may require an investigation by a third party into the fitness of the designated person to be guardian if an interested party raises the question.
