Workers’ Compensation 

Worker’s Compensation (sometimes called “workman’s comp”) is a state statutory provision applicable to persons injured in the workplace. It is usually controlled by the state in which the injury occurs. The applicable state statute governs the amount of relief available to the workers, as are the amount of attorney fees awarded. Medical care costs arising out of the injury are not limited, however. 

Worker’s Comp is an exclusive remedy for injury, which means the worker usually cannot sue his employer for job related injury. In exchange for the protection afforded to the employer, the employee is not required to prove fault or negligence. If the worker is injured on the job, they are covered. Sometime, injuries that appear to be unrelated to the job can be covered if the cause can be related back to the job.

There are sometimes circumstances that permit the injured worker to sue the manufacturer of a piece of equipment if it can be proven that the equipment is defective or if a safety provision is violated.
